CDN Printing retains the right to alter, adjust, or amend these Terms & Conditions without prior notice. 1. ORDER APPROVAL The customer is fully responsible for final proof and layout approval before the printing process. CDN Printing is NOT LIABLE for errors in the final product caused by any of the following reasons: misspelling, graphics, bleeds, grammar, damaged fonts, punctuation, incorrect cuts, missing folds, or incorrect finished product size. 2. COPYRIGHT All materials used or found on this website, or utilized in the production of your order, are subject to copyright. All rights are reserved worldwide. It is strictly prohibited to redistribute, copy, or republish any of the materials and software contained on the CDN Printing website and its subsidiaries (referred to herein as CDN Printing) or the copyrighted property of parties from whom CDN Printing has licensed such property. The Customer (sometimes referred to as "you" for convenience) may not incorporate or reproduce any trademarks, service marks, or logos that are not owned by you or licensed to you on materials and merchandise to be printed via the CDN Printing Service. Words, names, and designs used to identify services or products are considered trademarks, service marks, and/or logos. The same policy applies to copyrights. The exclusive rights of the copyright owner prohibit the reproduction of any original work. CDN Printing's policy also dictates that explicit language or pornography cannot be used on printed materials and merchandise. 3. CUSTOMER CONTENT All information, data, text, photographs, graphics, messages, or other materials supplied by the customer ("Content") are the sole responsibility of the customer. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. You agree not to use the Service to send, upload, post, or otherwise transmit any Content that contains: Child pornography or anything indecent, obscene, lewd, lascivious, filthy, or vile. A threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of Canada or the United States, or a threat of blackmail. Any matter advocating or urging treason, insurrection, or forcible resistance to any law of Canada or the United States. Any defamatory remarks directed at any other person or company. Any content that infringes the intellectual property rights or other proprietary rights of CDN Printing or any third party. CDN Printing does not control the Content posted by Customers and does not guarantee the accuracy, integrity, or quality of the Content. Under no circumstances will CDN Printing be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent, or objectionable. Products and services are provided for your personal use only. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation. You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions taken through your registered account. You acknowledge that CDN Printing does not pre-screen Content, but CDN Printing and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that CDN Printing may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) Comply with legal process. (b) Enforce the terms of service. (c) Respond to claims that the Content violates the rights of third parties. (d) Protect the rights, property, or personal safety of CDN Printing, its users, and the public. 4. GOVERNING LAW CDN Printing is a division of 1726374 Ontario Inc. and is headquartered in Ontario. Any legal action or proceeding relating to, or arising from, your access to or use of this site shall be initiated in Ontario. By using this site, you agree to submit to the jurisdiction of the Ontario courts and acknowledge that venue in these courts is appropriate for any such legal action or proceeding." 5. LIMITATION OF LIABILITY Under no circumstances shall CDN Printing or its licensors, suppliers, or vendors, along with their officers, directors, employees, or agents, be held liable for any special, incidental, indirect, or consequential damages of any nature. This includes damages resulting from the loss of use, data, or profits, whether or not CDN Printing has been informed of the potential for such damage, arising from or in connection with the use or performance of the site or the failure to provide services that you have ordered from CDN Printing or its affiliates. This encompasses damages arising from mistakes, omissions, viruses, delays, or service interruptions. In no event shall CDN Printing be liable or responsible for any damages or consequences arising from, or related to, your inappropriate or unauthorized use of the site or its content. 6. INDEMNITY You agree to indemnify and defend CDN Printing, as well as all parties from whom CDN Printing has licensed portions of Content, including their directors, officers, and employees, against any and all claims, liabilities, damages, costs, and expenses. This includes reasonable legal fees and expenses, arising either from (i) your violation of these Terms of Use or (ii) any lawsuit, claim, or demand arising due to or connected with any text, photograph, image, graphic, or other material that you have incorporated into Products. 7. CUSTOMER SUBMITTED ARTWORK OR GRAPHICS Artwork, designs, and images must be submitted in CMYK format. CDN Printing cannot be held responsible for any color shifts that may arise during conversions from RGB to CMYK color modes. It is essential that all artwork, designs, and images are provided at a minimum resolution of 300 DPI and in CMYK color mode. CDN Printing cannot be held responsible for printed images appearing fuzzy, distorted, or pixelated due to customer-provided artwork. Please note that extra charges may be applicable for files exceeding 30MB in size. 8. COLOR PROOFING & MATCHING CDN Printing bears no responsibility for color matching or ink density concerning screen proofs that have been approved by customers. Screen proofs are intended to predict design layout, text accuracy, image proportion, and placement, but they do not cover color or density aspects. While CDN Printing will make every effort to match the gradient density of each color, the final appearance of a color cannot be guaranteed. It's important to note that the application of UV coating might impact or alter the appearance of printed colors. Thus, CDN Printing cannot be held responsible for the final color appearance of UV-coated products. 9. ENVELOPES AND LETTERHEADS PAPER EFFECT IN COLOR. Please note that because our letterhead and envelope paper stock is "uncoated", we recommend you not use colors with high color density. By this we mean dark colors (black, purple, blue, brown, etc). Dark colors tend to get soaked into the paper if their color values are too high. For best results, use light colors. 10. ORDER CANCELLATION Orders can be canceled upon request via email until either 8 hours after ordering or the commencement of production, whichever comes first, and are subject to applicable cancellation charges. A credit voucher will be issued, valued equally to the canceled job(s). This voucher will have an expiry of six months from its initial activation. In cases where a job is canceled, charges for any labor hours (including proofing, graphic design, etc.) and administrative fees (such as credit card fees) will be deducted from your voucher. The minimum cancellation charge is $100, plus any applicable credit card fees. Once an order has been successfully placed, no refunds will be issued for Logo and Graphic design services. 11. RETURNS AND REFUNDS Due to the uniqueness of each customer's order and its lack of resale value, we adhere to an 'All Sales Are Final' policy. In the event that we confirm an error on our part, we will proceed with a re-print of the order. However, if a re-print is carried out, no refunds or credits will be issued. Should a customer decline a re-print offer, no refunds or credits will be provided. Customers are required to inform CDN Printing within 5 business days of order acceptance if they discover any defects in the received product. Failure to do so will imply customer satisfaction with the product. In cases where replacement is warranted, the customer must initiate the return of 100% of the received product within 7 days in its original package and condition (at their own expense) from the time of product delivery. Please note that all charges related to expedited printing (such as Rush Printing or Shipping) are non-refundable, even for orders returned for any reason. 12. ORDER SHIPPING AND DELIVERY While CDN Printing will make reasonable efforts to prevent delays in delivery schedules, under no circumstances shall CDN Printing be held liable for any consequential or incidental damages resulting from shipment or delivery delays. Orders are considered F.O.B. from the CDN Printing Plant, and customers should address any shipping issues exclusively with their chosen courier. CDN Printing is not responsible for delays in shipments caused by factors such as adverse weather conditions, shipping company delays, international customs issues, or any other unforeseen circumstances. Unanticipated equipment failure, malfunctions, or technical problems may also lead to printing process delays. In the event of delays caused by technical difficulties, applicable rush charges/fees will be either refunded or waived. However, it's important to note that technical difficulties will not serve as grounds for order cancellation. For high quantity products, shipping rates are contingent upon the customer's access to a shipping dock and forklift. Additional charges may apply if these facilities are not available 13. CUSTOMER SUPPLIED INCORRECT ADDRESS If a package is returned to CDN Printing due to an error made by the customer in providing the correct shipping address, CDN Printing will re-ship the package with the corrected address. Please note that an additional shipping fee will be charged for this reshipment. 14. CREDIT CARD CHARGES Order exceeding $1000 or greater may require an authorization form and copy of credit card and Driving license. CDN Printing reserves the right to refuse service without disclosing a reason. Completing any online order or proof forms is like completing them physically and signing them physically. 15. LINKS TO THIRD PARTY SITES The links provided on this site may direct you to external websites. Please be aware that these linked sites are beyond the control of CDN Printing, and as a result, CDN Printing cannot be held responsible for the content of any linked site or any link found within such sites. This includes any changes or updates to linked sites. Additionally, CDN Printing is not accountable for any webcasting or other forms of transmission received from these linked sites. These links are provided by CDN Printing for your convenience only, and their inclusion does not imply endorsement of the site by CDN Printing. If you have chosen to include a Spotify link with your item, please be aware that CDN Printing and its affiliates, along with designers, reserve the right to withhold its placement on the product without prior client notification. This may be due to potential delays in expedited production times or if it poses a risk to the product. 16: METAL CARDS & FX LASER CUT/DIE CUT SILK OR VELVET THICK 32 PT AND 48 PT. CARDS These cards are custom-made, with each step carried out individually. Because they are crafted from metal, which is heavier and harder to handle, it's important to note that each card may not be an exact replica of the others. Minor imperfections might be present, such as exposed non-colored edges, which are particularly noticeable on mirror finishes. To protect against scratches, each card is individually placed in a plastic sleeve, as metals are prone to scratching and denting. This sensitivity is even higher for mirror or sandblast-finished cards. For laser-cut and die-cut FX 32 pt. and 48 pt. business cards, these follow the industry-standard tolerance of up to 0.0625” to 0.125” in any direction (up, down, left, or right). Card-to-card variations will occur, as these cards are created in layers and then assembled before die-cutting. The corners are never sharp and are slightly rounded. For sharp corners, there will be a special handling charge or they will be charged like metal business cards. All FX 16 pt, 32-49 pt. business cards are non-refundable. A one-time re-print is offered only if there was a material defect. In such a case, the item must be returned in its original condition and weight to the CDN Printing location in Burlington within 7 business days. If the item is picked up, it is assumed that you have reviewed the item, and you can request a re-print and leave the product at the location. As a courtesy, we allow 24 hours to view the product at home and bring it back, along with any unused complimentary cards, to the location no later than 2 business days." Please be aware that due to the intricate nature of the process and the challenges posed by metal, your order might be short by up to 10% as part of our quality control efforts. If you encounter any issues, kindly inform our team within 7 days of receiving the order so that we can promptly address the matter. Once a proof has been generated for metal cards, please understand that orders cannot be cancelled or refunded for any reason, as the complex engineering of the cards makes this infeasible. 17. LENTICULAR CARDS This technology operates quite differently, and it's important to note that lenticular printing resolution cannot match that of regular printing on traditional materials. Lenticular printing involves layering effects to achieve animated movement, and as a result, it cannot offer the same clarity as standard printing. This is due to the presence of multiple images on the lenticular side. The lenticular plastic material responsible for creating these effects features ridges and angles. The ridge size varies from hairline to 1 point. For fonts or characters to be discernible, they must be a minimum of 10 points. Lenticular printing serves to transition between images, which is its primary function. Industry standards dictate that cutting may result in a shift of 0.0625 inch to 0.125 inch, which falls within accepted norms. Once the item is delivered, please be aware that it becomes non- refundable. It's important to consider these items as novelty items, given their unique characteristics and manufacturing process. 18. COLOUR MATCHING Due to variations in equipment, paper, inks, and other factors between color proofing and production press room operations, it is anticipated and unavoidable that there will be reasonable differences in color between color proofs and the final completed job. Such variations are deemed acceptable in the printing industry. While CDN Printing will exert every effort to achieve a reasonable representation based on the materials provided by the customer, we cannot guarantee precise color matching. It's important to acknowledge that occasionally, color misrepresentation occurs due to the nature of soft proofing, arising from differences in monitor calibration from one screen to another. 19. OVER RUNS AND UNDER RUNS A quantity variation of up to 10% in overruns or underruns from the ordered quantity shall be considered an acceptable delivery. 20. INDEMNIFICATIONS By submitting artwork, photos, and other materials for printing, the customer asserts ownership or publication rights to these materials and thereby agrees to indemnify and hold CDN Printing harmless from any losses, costs, expenses, and damages arising due to claims, demands, actions, or proceedings. These claims may allege that the printing violates copyrights or proprietary rights of any person, or that it contains libelous, scandalous content, or infringes upon privacy or other personal rights of individuals. This indemnification is applicable except to the extent that CDN Printing contributed to the content in question. The customer commits to promptly and at their own expense, defending and maintaining the defense of any such claim, demand, action, or proceeding brought against CDN Printing. CDN Printing will provide timely notice to the customer regarding such matters. 21. REFUND POLICY To initiate a refund for printed materials, the customer should return the items to CDN Printing.com at their own expense. The return must maintain the original weight, condition, and packaging. Our quality control department will then conduct an inspection to verify the legitimacy of the complaint. It's noteworthy that the quality may differ based on the specific stock utilized for printing. Customers bear the responsibility of ensuring that the artwork they provide adheres to our setup instructions. This entails requirements such as having the artwork in CMYK and ensuring all gradients are flattened. It's important to recognize that items printed on a standard press might differ from those produced using our digital label system, which employs plastic and polypropylene materials. It's crucial to understand that rush orders are undertaken at the client's own risk. Due to the ongoing pandemic, we may be unable to accept returns for custom imprinted items 22. FABRIC PRINTING Our Vapour Technology represents the finest approach, offering enduring wear and seamlessly embedding the print into the fabric. This ensures an exceptional, long-lasting finish. For Dye Sublimation printing, we employ a method akin to Vapour Technology, although it's predominantly employed for our promotional products. Additionally, there's our screen printing technique, which is suitable for single-color designs. While it provides vibrancy, over time, it might develop cracks, particularly if not laundered correctly. Similar to screen printing, DTG (Direct-to-Garment) delivers full-color printing capabilities. However, like screen printing, it can encounter cracking concerns over time. Our vinyl option presents another choice. While it shares some downsides with screen printing, it can offer unique effects. Lastly, we've introduced a novel process that combines elements of vinyl and screen printing. This choice is beneficial for larger quantity orders, aligning it with the principles of screen printing
